General information on the processing of your personal data & specific information regarding visits to our website

Here we have compiled all the information for you regarding the processing of your personal data by us, Metall-Chemie Technologies GmbH, as well as your rights under data protection law. Specific information regarding access to our website, in particular regarding the use of forms, can be found here under points 4 and 5.

3. We require your personal data for the following purposes: We
use your personal data to fulfil pre-contractual, contractual or post-contractual obligations, as well as legal obligations (Article 6(1)(b) and (c) of the GDPR)

We require your personal data when you enter into a contract with us or in connection with legal obligations to which we are subject, e.g.
– when you purchase a product from us,
– in connection with the guarantees we provide, or
– to fulfil our statutory warranty obligations.

However, we sometimes also need your personal data before you enter into a contract with us, or even afterwards (e.g. to prepare a quotation, to agree terms and conditions, to clarify any ambiguities in the order, to process returns, or to arrange refunds). We also process your personal data to fulfil other legal obligations to which we are subject (e.g. tax obligations).

We use your personal data to safeguard our legitimate interests or those of a third party (Article 6(1)(f) of the GDPR)

We also process your personal data where we or a third party have a legitimate interest in doing so: for example, to mitigate our credit risk, we may obtain a credit reference or arrange for debt collection; and, in the context of a business relationship, we process the contact details of our business customers’ contact persons. We also use your personal data for direct marketing purposes, provided you have not objected to this.

We use your personal data where you have given your consent (Article 6(1)(a) of the GDPR)

In specific cases, we require your explicit consent to process your personal data. In such cases, we will ask for your consent in advance and inform you separately in this regard.

4. Informational use of our website
Your IP address is processed by our web host (data processor) whilst you are accessing our website; without processing your IP address, we would be unable to display the website in your web browser. Your IP address is stored briefly in the web server’s temporary memory whilst the website is being transmitted to you; it is then deleted immediately. The processing of the IP address in this context is carried out on the basis of Article 6(1)(f) of the GDPR.

For purely technical reasons, we already use transient cookies in the informational section of our website. Transient cookies are automatically deleted when you close your browser. These cookies are temporarily stored in your browser’s working memory. Although these cookies are set, we do not analyse them. The use of cookies is based on Article 6(1)(f) of the GDPR.

5. Use of our web forms
You are free  to use our web forms at any time. You may enter whatever personal data you deem necessary. Mandatory fields are marked with an asterisk. We require this information to contact you (e.g. your email address and a subject line). We process the personal data you provide to us in this way in order to respond to your enquiry. Processing takes place either in the context of pre-contractual, contractual or post-contractual measures (e.g. in response to a request for a quotation or in connection with warranty or guarantee claims) (Article 6(1)(b) of the GDPR) or, in the case of any other enquiry you may have, on the basis of our legitimate interest (Article 6(1)(f) of the GDPR).

6. Your obligation to provide personal data 
If we are to act on your behalf (e.g. under a contract), we can only do so if you provide us with all the personal data required for this purpose. If you do not wish to do so, we cannot act on your behalf. In some cases, there is also a legal obligation to provide us with your personal data; we will inform you separately in such cases.

7. We obtain personal data from these sources 
We process the personal data that we receive from you. In addition, where permitted, we process personal data that we obtain from public sources (e.g. debtor registers (creditworthiness data)) or other sources (e.g. credit reference agencies (creditworthiness data)). We will be happy to provide you with further details on this in specific individual cases.

This site uses web fonts from Monotype GmbH (fonts.com or fast.fonts.net) to ensure consistent font display. When you visit a page, your browser loads the required web fonts into its cache. To do this, your browser connects to the servers of fonts.com.

9. Your rights
If you would like to know what (personal) data we hold about you, we will let you know, as you have a right of access under Article 15 of the GDPR in conjunction with Section 34 of the BDSG.

If you inform us that any personal data is incorrect, we must rectify that personal data. You have a right to rectification under Article 16 of the GDPR.

You have the right to have your personal data erased under Article 17 of the GDPR in conjunction with Section 35 of the BDSG.

In rare cases (e.g. if it is unclear whether personal data is correct or incorrect, or if we would like to erase your personal data but you do not wish us to do so), you may request that the processing of your personal data be restricted. You have the right to restrict the processing of your personal data under Article 18 of the GDPR.

You have the right to object under Article 21 of the GDPR.

You may withdraw any consent you have given to the processing of your personal data at any time with effect for the future.

If you do not wish to receive direct marketing from us, you may object to this at any time and we will no longer use your personal data for direct marketing purposes in future.

If you object to the processing of your personal data, this does not affect the lawfulness of the processing carried out on the basis of your consent prior to your objection.

You have a right to data portability under Article 20 of the GDPR. Exercising your rights will not normally incur any cost. Please contact us in such cases.

If you have a complaint or a question regarding data protection, please contact us (see point 1 above) or our Data Protection Officer (see point 2 above). You also have the right to lodge a complaint with a supervisory authority.

10. Recipients to whom we disclose your personal data 
We use your personal data within Metall-Chemie Technologies GmbH to fulfil our contractual or legal obligations.

Where necessary and permissible, or where required by law, we may disclose your personal data to third parties or to data processors. Data processors process personal data on our behalf and exclusively in accordance with our instructions. Third parties or data processors include, for example, public authorities or IT companies (e.g. to operate our website), credit reference agencies (for credit checks), debt collection agencies, and distributors (for the delivery of products).

11. We store your personal data for as short a period as possible.
We store your personal data for as long as is necessary to fulfil our contractual or legal obligations. Your personal data will then be deleted as soon as we no longer require it, for example because you have unsubscribed from the email newsletter and no law requires us to retain it any longer. Your personal data will not be deleted as long as it is required for the establishment, exercise or defence of legal claims.

12. No transfer to countries outside the EU 
Your personal data will not be transferred to countries outside the EU or to international organisations. We do not carry out any processing based on automated decision-making. We do not carry out any profiling (automated processing with the aim of evaluating certain personal aspects).
